The purpose of the Website is to provide commercial information about the private boat charter services offered by NÁUTICA SPRING DE PROA, S.L. under the trading name "Rumbo Salou", including private boat trips, sport fishing and boat hire with a professional skipper from Salou Marina (Costa Dorada, Tarragona), and to enable the online booking of such services.

3. General terms of use

Accessing, browsing and using the Website confer the status of user, and entail full and unreserved acceptance of each and every provision set out in this Legal Notice, as well as in the Privacy Policy and the Cookies Policy.

The user undertakes to use the Website, its contents and services in accordance with applicable law, public morals, generally accepted standards of conduct and public order. The user further undertakes not to use them for unlawful purposes or effects, contrary to the provisions of this Legal Notice, harmful to the interests or rights of third parties, or which may in any way damage, disable, overburden or impair the Website or prevent its normal use.

4. Intellectual and industrial property

All contents of the Website — including, by way of example and without limitation, texts, photographs, images, graphics, videos, illustrations, graphic design, source code, trademarks, logos, trade names and other distinctive signs — are the exclusive property of NÁUTICA SPRING DE PROA, S.L. or of third parties that have expressly authorised their use, and are protected by Spanish and international intellectual and industrial property legislation.

The reproduction, distribution, public communication, transformation or any other form of exploitation, in whole or in part, of the contents of the Website without the prior, express and written consent of NÁUTICA SPRING DE PROA, S.L. is expressly prohibited. Any unauthorised use shall be deemed a serious infringement of the owner's intellectual or industrial property rights.

The "Rumbo Salou" trademark and the distinctive signs contained therein are owned by NÁUTICA SPRING DE PROA, S.L. or used under the relevant authorisation.

The Website may contain links to third-party websites (Google Maps, social networks, the Stripe payment gateway, etc.). NÁUTICA SPRING DE PROA, S.L. accepts no responsibility whatsoever for the content, information, services, privacy policies or practices of such external sites. The inclusion of these links is for informational purposes only and in no case implies endorsement, association or affiliation.

6. Exclusion of warranties and liability

NÁUTICA SPRING DE PROA, S.L. makes reasonable efforts to ensure the availability, accuracy and truthfulness of the information contained on the Website. It does not, however, guarantee that its contents are free from errors or omissions, nor that they are accurate, complete or up to date at all times.

NÁUTICA SPRING DE PROA, S.L. shall not be liable for any damages of any nature whatsoever that may arise from: (i) the unavailability or lack of continuity in the operation of the Website; (ii) the presence of viruses, malicious programs or any other harmful elements; (iii) any unlawful, negligent, fraudulent use or any use contrary to this Legal Notice; (iv) the truthfulness, accuracy or lawfulness of information provided by third parties through the Website.

The processing of any personal data that the user may provide through the Website shall be governed by the provisions of the Privacy Policy, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR), and with Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD).

10. Applicable law and jurisdiction

This Legal Notice is governed in its entirety by Spanish law. Any dispute arising from its interpretation or application shall be submitted to the Courts and Tribunals of the consumer's place of residence, as established in the consolidated text of the Spanish Consumer Protection Act (Royal Legislative Decree 1/2007).

13. Cancellation, charge policy and off-session payment mandate

13.1 Card-as-guarantee booking model (standard services)

Most of Rumbo Salou's charter services (sunset, coves, hen/stag parties, shared and private fishing, among others) use the card-as-guarantee model: no amount is charged at the time of booking; instead, the user's card details are securely stored in the Stripe payment gateway (Level 1 PCI-DSS certified) via a SetupIntent with off-session authorisation in compliance with PSD2/SCA. The full amount is paid on boarding day, in hand, in cash or by card.

By confirming a booking, the user expressly authorises NÁUTICA SPRING DE PROA, S.L. to make automatic charges on the stored card in the cases set out below. This authorisation constitutes an off-session payment mandate in accordance with SEPA/SCA regulations and remains in force until the card is released (booking closed or cancelled).

Charge policy for cancellation or no-show, calculated on the total booking price:

• Cancellation 7 or more days before boarding: no charge. The card is released without any debit.
• Cancellation within the 7 days prior to boarding (late cancellation): a charge of 15 % of the total booking price is applied as compensation for management and opportunity costs. The remaining amount is not charged.
• No-show on boarding day without prior notice: a charge of 50 % of the total price is applied as a penalty for an unfulfilled booking without notice.
• Cancellation by NÁUTICA SPRING DE PROA, S.L. due to weather, rough sea, safety reasons or any other cause attributable to the service provider: no charge. The card is released and rescheduling to another date is offered by mutual agreement.

Penalty percentages may vary by service within the legally permitted range. The user sees the percentage applicable to their specific booking before confirming, both on the service detail page and in the booking modal and confirmation email.

Automatic charges are processed through Stripe using the stored card and appear on the user's statement as "RUMBOSALOU" or "NAUTICA SPRING DE PROA". The user may cancel their booking at any time via the secure link included in the confirmation email, with the described policy applying automatically.

13.2 Upfront-deposit booking model (special events)

For certain special events with limited spots (e.g. Total Solar Eclipse 2026 or Tarragona Fireworks), the booking requires the upfront payment of a per-person deposit, charged at the time of booking via Stripe. Specific conditions:

• If the user cancels 7 or more days before boarding, the deposit is refunded in full.
• If the user cancels within the 7 days prior, the deposit is non-refundable.
• If NÁUTICA SPRING DE PROA, S.L. cancels the event due to weather, safety or any cause attributable to the provider, 100% of the amount paid is refunded or rescheduling is offered at no cost.

13.3 Refunds and consent revocation

Refunds, where applicable, are issued to the same payment method used for the booking (Stripe), within approximately 5 to 10 business days. The user may revoke the off-session payment mandate at any time by requesting the cancellation of the booking through the described procedure. The off-session mandate will under no circumstances be used for purposes other than those described in this section.
